Abstract
The book Shielding Europe with the Common Security and Defence Policy: The EU Legal Framework for the Development of an Innovative European Defence Industry in Times of a Changing Global Security Environment delves into a critical issue in today’s security landscape, namely, the development of the defence industry within the European Union and its Member States. As new threats and global powers emerge, EU leaders have recognized the need to bolster defence capacities and reduce reliance on external security providers. Achieving this goal is far from straightforward. The EU was founded on pacifist ideals, emphasizing economic cooperation to prevent conflict. As such, adapting the EU’s legal and institutional frameworks to support military cooperation and the development of a robust defence industry poses significant challenges - challenges which the authors of this book seek to address. The book has a two-fold objective. First, it aims to identify and examine the applicable legal frameworks. Second, it seeks to highlight the uncharted areas and legal obstacles that must be addressed to enable the development of a European defence industry. Additionally, several contributors offer suggestions for potential improvements, directed at both European and national lawmakers.
The book is structured into five parts: Part I focuses on key policy issues; Part II presents the legal framework governing the Common Security and Defence Policy (CSDP); Part III explores the legal context specifically related to investment and financing aspects of defence industrial development; Parts IV and V address legal and practical aspects associated with military innovation and the protection of critical infrastructure within the EU.
