Serbia: Assisted Reproductive Technologies – Liberal or Restrictive Approach

Authors

Synopsis

In this chapter, the author analyses Serbian legislation on Assisted Reproductive Technologies (ART) in comparison with the regulation of some European countries, especially where there are discrepancies in regulation. In particular, the following issues are presented: which institutions can perform ART and who covers the costs, which procedures are allowed and which are not, and who the beneficiaries (subjects) of ART are. Special attention is given to children’s rights and interests in relation to ART (e.g. the child’s right to know his/her biological origin, and the child’s right/interest in having two parents). The court practice on ART in Serbia and comparatively, as well as the court practice of the European Court for Human Rights, is presented.
