In Search of an International Standard for the Use of Assisted Reproductive Technologies
Synopsis
The use of assisted reproduction techniques (ART) concerns one of the most intimate spheres of human life, which is procreation. It is therefore not surprising that ART is of interest not only to medicine, ethics and religion, but also to law. Lawyers are trying to answer the question, among others, whether it is possible to create an international complete and consistent standard (system) regulating the use of assisted reproductive technologies. Such a standard (at least in principle) should take into account both universal human rights based on the respect for and the protection of human dignity and freedom, as well as the specificity of regional and national ethical, cultural, religious and social and, of course, legal contexts. The aim of this study, which is the eponymous search for an international standard for the application of ART, will be achieved by means of a legal and comparative analysis taking into account acts of international law of a universal and regional nature, selected case law and literature on the subject.
